The Agreement Between You and Us
- These Terms and Conditions, together with our Privacy Policy and any sign up form(s), order form or payment instructions comprise the whole agreement between You and Us in relation to each order that We accept from You.
- All purchase of services from the Site and in store will be governed by these Terms and Conditions to the exclusion of any other terms
- By browsing the Site or submitting an order online, via telephone or in store, you agree to be bound by these Terms and Conditions
- By placing an order, You acknowledge that You have not relied on any statement, warranty or representation other than those which are made in these Terms and Conditions, Our Privacy Policy, any sign up form, order form or any any payment instructions.
Course Bookings
- By choosing to undertake a training course with Dive Rutland you agree to all the Terms and Conditions laid out in this document. Should you not understand or fully agree to the terms and conditions, you will be expected to ask for clarification. As soon as a deposit payment is made for the course, you accept that you understand said terms and conditions
- By paying a deposit you are entering into a legally binding contract. If you change your mind and do not pay the balance due, you will be in breach of contract and we will be entitled to retain the deposit in full and not return it to you.
- All activities are subject to availability.
- Dive Rutland may accept or decline bookings, and may withdraw any offer, discount or promotion at any time.
- Your booking shall only be accepted when Dive Rutland have received the amounts due and have issued you with written acceptance.
- Courses are offered on a flexible basis, where customers can, within reason choose dates that suit them. Once a date has been agreed however, the centre will make arrangements for the provision of staff, materials and make other arrangements, which will incur a cost to the student should the student make, unagreed adjustments to the course dates or Fails to turn up or reschedule in line with these terms and conditions.

Course Deposits and Fees
- For PADI Experience Programmes – Discover Scuba, Discover Snorkelling, Bubblemakers, PADI Specialties and Scuba Parties, full payment is required on booking. On receipt of full payment and a completed booking form, confirmation and full details will be sent to you.
- All PADI Courses require a booking in advance and the final payment is due on the first day of your course. The receipt of part payment and booking form will release your course materials and your course dates will then be confirmed. When we accept your booking, we will provide you (by post at cost, or upon collection, at your election) with any required PADI course materials which are included in your course fee.
- PADI Open Water course pricing assumes that the student will complete the confined water sections of which there are five, within six pool sessions. Six pool sessions is deemed to allow the student additional time without any pressure in the event of any skills / performance issues. This equates to over 12 hours of confined water time. If additional sessions are required, then these will be charged on a BOOST: per session basis.
- PADI Open Water course pricing assumes that the student will complete the open water dives of which there are four over two days at the agreed training location. If additional open water sessions are required due to performance requirements not being met, then subject to Open Water dive 2 being completed the PADI Scuba Diver certification will be processed. However, the student can choose to attend additional open water training dates to complete the full certification, these will be charged at the price of a BOOST: Open Water or take a PADI Open Water referral
- For the PADI PRO course (Divemaster & IDC) a crewpack is also required and this will need to be paid in advance. Only on receipt of payment and completed booking form, will your course pack be released. Due to the size of the Divemaster pack it is not possible for this to be posted. Divemaster courses will require attendance at mandatory theory workshops.
- All Deposits and payments are valid for six months only. Extending the length of a deposit or payment can be negotiated before the end of the 6 months from the original booking by contacting Dive Rutland. Fees may apply. *this term has been extended to 12 months due to COV-19 pandemic*
- Course deposits are non-refundable, unless the course is unable to commence due to medical grounds - see medical cancellation. We recommend that you take out your own insurance to cover any cancellation,
- Any non-attendance of scheduled sessions will be charged at the current no-show session rate.
- All courses exclude the cost of entry to dive sites, boat fees and transportation costs unless otherwise stated.
- Any change in course dates will result in an administration fee for each and every change made, unless otherwise agreed.
- All PADI training is valid for 12 months from the last documented training session. If your training extends beyond this period, You will be required to pay for additional sessions to continue.
- Your certification will be withheld if Your course balance is not paid in full
Rescheduling and No Shows
- Occasionally students require changes to their booking dates. Dive Rutland will assist in every possible way to accommodate the changes.
- ‘No Shows’ are when students fail to attend scheduled sessions without giving any notice. Payments made for the session will not be refunded or credited to a future session.
- A No Show or failure to turn up on time, or at all for single components of a course without 7 days prior notification (i.e. a pool session or an open water session) resulting in a requirement to reschedule will result in a Reschedule AND a No Show fee being charged.
- A No-show or failure to turn up on time that does not require rescheduling will result in no additional charge.
- If you are unable to attend a course, or part of a course and provide more than 14 days notice, we will always endeavour to reschedule your course to another date that is suitable to you without extra charges. We do not provide any refunds and any part payments made for courses will remain in credit on said account for up to 1 year from booking date.
- If the rescheduling of any course involves the start date occurring after any course price change then the new course price will become payable, unless the reschedule is due to a postponement undertaken by Dive Rutland.
- Failure to complete the full course requirements within 12 months of starting the course, for any reason caused by the student will result in additional charges being made to complete the course at a later stage. This includes and is not limited to not being able to demonstrate competence to meet the performance requirements as laid down by the PADI Course Standards. These charges will be for staff time, any entrance fees, equipment and material requirements, surface cover time, vehicle and transport charges etc. If you are not willing to pay additional fees to complete your course, a referral document will be issued to you (where possible – some courses do not have a referral option), which will hold good for a period of 12 months from the date of last portion of the course completed.
- In the event that a situation arises and Dive Rutland are unable to deliver your course on pre-arranged dates, we will endeavour to give you as much notice as possible and will reschedule your course.
- Dive Rutland reserve the right to postpone courses if PADI Professionals are not fit to dive or if weather conditions render student diving unsafe. Risk assessment controls will determine conditions to dive.
- In the event that a situation arises and Dive Rutland are unable to deliver your pool / classroom hire on pre-arranged dates, we will endeavour to give you as much notice as possible and will re-schedule your dates. Dive Rutland reserves the right to cancel any hire of the pool and classroom sessions.
Cancellations - Non Medical
Course can be cancelled by customers up to 7 days after booking (date of invoice) for any reason, and refunds will be given IF
If outside of the above timeframes then the deposits will be held on account for up to 1 year from booking date as per t&c above in rescheduling and no shows.
- PADI Physical Materials returned clean, unmarked and in the original packaging
- PADI elearning can only be refunded if not activated
- Not within 21 days of the course start date

Cancellations - Medical
- If you cancel your course or diving experience due to medical reasons we require a medical certificate from your GP within 7 days.
- If you reschedule your course or diving experience due to medical reasons we require a medical certificate from your GP within 7 days. Failure to provide within 7 days will result in the listed Rescheduling Fee for that course being charged.
Personal and Credit Card Details
- We are required to hold your personal details for a period of 7 years as required by PADI International Limited. We will at all times, treat your details with respect and will not share them with any other company.
- Credit card details are not retained.
Equipment
- Candidates using Dive Rutland's and / or Dive Rutland Dive Professional's equipment for any course are responsible for that equipment and will be charged for any loss or damage caused. A Buoyancy Control Device will be worn during all open water activities.
- Students using their own diving equipment must inform the course instructor and provide all evidence that the equipment is serviced as per manufactures or industry standards and requirements and the product is CE rated
General Rules
- Candidates agree to abide by the rules and decisions of Dive Rutland, its staff and subcontractors in all diving activities.
- A no refund policy is in operation for any course that has been started and then subsequently terminated by either the Student or Dive Rutland.
- Dive Rutland will endeavour to ensure students progress successfully throughout any course. We cannot be held responsible if a student fails to attend or withdraw from any part of the course or is unable to complete or continue the course.
- Course objectives must be met and all skills mastered to the satisfaction of Dive Rutland Instructors before certification will be issued.
Force Majeure
Any event beyond the reasonable control of the affected party, which cannot be reasonably planned for or avoided.
- Dive Rutland shall not be liable to the purchaser as a result of any delay or failure to provide the Course as a result of a Force Majeure Event.
- Where a Course is postponed by us due to a Force Majeure Event then the parties shall, acting in good faith, agree a new date for the provision of the Course.
- We will not be liable for any loss or damage suffered or incurred by you arising from our delay in fulfilling or failure to fulfil or otherwise discharge any of our obligations under the contract, to the extent that such delay or failure is caused by any circumstance beyond our reasonable control.
Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address and all notices from us to you will be displayed on our website or via mailshot or email or our social media channels
Entire Agreement
These terms and conditions form the entire agreement between us in respect of any booking, and exclude all other terms and conditions. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty which is not set out in these terms and conditions.
Nothing in these terms or conditions affects your statutory rights, or excludes or limits liability to a greater extent than permitted by applicable law.
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

Applicable Law
These terms and conditions, their subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction in relation to any dispute or claim concerning these terms and conditions or their subject matter or formation (including non-contractual disputes or claims).

Why the charges? When a course has been scheduled, we make arrangements for the provision of staff, materials, pool and site bookings along with a number of other arrangements which all have associated costs.
Technical Courses
Our RAID Deco courses are currently supplied by Diving Matrix supported by Dive Rutland Technical Instructors. Dive Rutland, facilitate your course booking and provide access to the RAID e-learning course materials as part of your course fee, but ALL other aspects of the course are provided direct by Diving Matrix and therefore the course booking is subject to Diving Matrix Terms and Conditions.

Cancellation
- We must receive a deposit as stated in the trip details in order to secure your booking.
- Your space is booked and secure once your deposit is received.
- Your deposit is not refundable.
- If you pull out of the trip you are still liable for the amount owed unless you can sell your spot on. If there is a waiting list for the trip we will inform the waiting list on your behalf.
- Any costs incurred by the change will be your responsibility.
- Full payment is required 24 weeks prior to departure or as per the trip booking supplier's terms and conditions
- All diving is to be undertaken within the scope of Your training
- No liability will attach to Dive Rutland Limited in respect of any loss or damage or personal injury whilst on any organised trip by Dive Rutland
Cancellation
- Dive Rutland will inform you of any changes or cancellations with as much notice as possible
- Where a Boat Operator has cancelled a Boat Dive - subject to the Terms and conditions of the operator one of two things will occur. The booking will be carried forward to a reschedule date or a refund in full
- If the weather or any circumstances beyond the control of Dive Rutland cause the Shore Dive to be delayed, changed or cancelled, no liability can be accepted by the aforesaid parties for consequential loss, damage or any expense incurred
- We recommend that you take out insurance to cover any cancellations
Other Destinations
- We must receive a deposit as stated in the trip details in order to secure Your booking
- Deposits are non-refundable
- You are subject to the Terms and Conditions set out by our Trip provider
- If you are unable to attend after paying for the trip then subject to the Terms and Conditions of the Trip provider You might be able to resell your space to recoup your costs; any costs incurred by the Dive Centre in adjusting the booking will be charged.
- We recommend that you take out insurance to cover any cancellations, diving injury treatment and medical repatriation
- No liability will attach to Dive Rutland Limited in respect of any loss or damage or personal injury whilst on any organised trip by Dive Rutland
